Only the police can record your call details (present and future only) as per Section 5(2) Telegraph Act and 419 A of Rules with the help of the concerned service provider. that is legal as per above sections.
Section 5(2) of the act allows central and state governments to prevent the transmission of messaging during a Òpublic emergency or in the interest of public safetyÓ, or Òin the interests of the sovereignty and integrity of India, the security of the stateÓ.
As mentioned above that is the only time your call recrdings maybe be intercepted.
Cyber Crime Cell does not have any power to call for records of the conversations between you does not fall within the realm of ‘cyber crime’.
It is only a court of law which can order the service provider to submit the call records.
However, it will be profitable for you to know that service providers do not retain the contents of a telephonic conversation unless specifically ordered to do so on a binding obligation of law.
No one can retain anyones telephonic conversation, so no one can just go and demand for those recorded conversation as it is not allowed to do so.
You do not need to worry about that, no on will get get call recordings.
