A GPA is the power given by a person to an acquaintance to carry out specific financial or legal business on his or her behalf. Generally, people give the GPA to a trustworthy person who holds the right to carry out business on their behalf.
A GPA is not a compulsorily registrable document. However, it has to be stamped adequately to ensure it is enforceable and admissible as evidence in a court of law if a dispute arises between the parties.
To register a General Power of Attorney, the stamp duty will be payable as per the Indian Stamp Act, 1899, along with the registration fee. In the case where a GPA has been given for consideration, the stamp duty will be the same as the stamp duty which is payable on the sale deed of the property. It is based on the market value of the property.
In the event a SPA is executed by the owner of a property in favour of one or more persons, conferring the power to present documents executed by the owner before registration authorities, it is registrable.
The stamp duty payable is Rs 200 and the registration fee is Rs 100. You must consult the registrar, and it varies from case to case.
