Disposal means the case is not pending now . Disposal may be in the sense of allow or dismissal, may be some observation also. it appears from the status that the court heard the matter and decided the case finally.A Disposed Case can be reopened for many reasons:
If either the party to the case is not satisfied with the final judgment.
Due to some mistake, the relief can be granted
If any new evidence is found relating to the case which can alter the judgment
TIME LIMIT FOR DISPOSAL OF CASES
There is no such time limit for the disposal of cases. However, the upper courts can direct the Lower courts to dispose the cases as early as possible. The Government is making efforts to set up fast track courts for speedy trial of the cases so that the cases like rape, check bounce, village court cases can get justice as early as possible.
WHY THERE IS A DELAY IN THE DISPOSAL OF CASES?
In recent years, an increase in litigation cases is seen due to which there is a delay in the disposal of the cases. One of the reasons is the people drag their point of grievances in the court of law which can be solved even outside the court. People should be made aware of the Mediation which can help a lot of cases to be solved outside the courts. In India, the number of Judges should be increased as per the requirement.
DISPOSED PENDING CASE STATUS
A pending case is a case that was started but not completed yet. A case is a pending lawsuit until and unless the judgment is delivered by the court. A recent survey suggests that there are 1.44 crore cases pending in the criminal court.
In the case of Union Carbide Corporation v. Union of India and others[4], there are a number of people who suffered injuries. Years have passed still the people are not being compensated for the harm they have suffered.
