What is the fees of lawyer for property search and preparation of title and registration?


A property search traces the history of a property and helps in establishing the original owner of the property and how it has moved hands over a period of time before reaching the present seller.
The fees of lawyer for the lawyer depends upon the market value and location of the property.

The charges for registration and stamp duty put together can come up to 7% to 10% of the total market value of the property or more than that. In most of the states in India, 5-7% of the total market value of the property is said to be charged as stamp duty while 1% is said to be charged as registration fee.

It is to be noted that there is no fixed fees for lawyers in the case of registration of property. But in general practice lawyers charge legal fees ranging from 1% to 2% of market value of property for registration.

The Property Sale Agreement comes within the ambit of the Indian Contract Act 1872, the Registration Act 1908 and the Transfer of Property Act, 1882. Under these Acts it is always imperative to enter into a contract through written agreement so that the property’s ownership is legally established.
Registration of Property Agreement is mandatory under the provisions of law.
