The court fee is nominal at Rs 15, but the bulk is taken up by lawyer’s fees. While women can avail of free legal services by getting an advocate from the legal aid cell, private lawyers’ fee can vary from Rs 10,000 to Rs 1 lakh, depending on the type of divorce and duration involved.

It is understood and expected of a good lawyer to charge more fee compared to any other decent lawyer. A well-established lawyer might even take fees per hearing which he will make in the court. For every draft, every application, he might charge a hefty amount. One of the factors which a lawyer considers while deciding his fees is the financial status of the party.

In India, there are different and separate enactments for every personal law. For Hindus, the matter relating to marriage and divorce are dealt with the Hindu Marriage Act. In the same way, Indian Muslim are governed by their personal Shariah law and Quran. In Hindu-dominated cities, it is often difficult to find good lawyers who can fight Muslim divorce cases and ultimately they charge a good amount for their consultation.

The courts fee is very less and any one can afford that but the main game is played by the lawyers and the court fee per hearing depends on their charges. If you have a good relative lawyer than you can save too much amount on each hearing because a relative would charge a lower fee than the others.
